, 2016 我国虽然在1997年《刑法》就依法不负刑事责任的精神病人规定了强制医疗制度，但由于缺乏相对应的程序性规定，致使该规定流于形式。2012年《刑事诉讼法》修改将强制医疗的特别程序列入其中，弥补了立法的漏洞，对于公权力的限制、精神病人及社会公众的权利保障都起到了十分积极的作用。我们在看到立法进步的同时，也注意到在具体施行过程中，还需要进一步厘清条文涵义、阐明适用内容、防范滥用可能，从而确保其所追求的保障人权和防卫社会的目的实现。 本文结合司法实践，按照法解释学的方法和原则，根据现有的法律规定，以文义解释为基础，
