In the nonemergency medical encounter, however, such consent is ineffective as a defense1 without a full understanding of what it is that is being consented to.

Consent Forms and Consent Formalism
SSRN Electronic Journal, 2012Law enforcement officers frequently use written consent forms to obtain permission for searches. Consent forms are pervasive — indeed, more than ninety percent of state police departments use them in at least some circumstances. Moreover, consent forms are popular — traditional advocates for civil liberties, such as the ACLU, have championed their use.

Consenting to the Consent Form
Qualitative Inquiry, 2007Grounded in the author's dissertation study, this article presents the negotiations of the formal and informal expectations arising out of interpretations of the consent form. These negotiations disrupt the structure of qualitative inquiry and its associated guidelines for academic rigor, trustworthiness, and transferability.
