Abstract The mainstream and regulatory offences recognized or (in the main) created by the FSMA have been explained in Chapter 2. This chapter addresses the role of the FSA as a prosecuting authority, and its right to bring criminal proceedings in pursuit of its regulatory objective under section 6 of the FSMA of reducing financial crime.
