污染环境罪与投放危险物质罪隶属不同章节,本不应有交集,但典型案例中,却出现了污染环境罪与投放危险物质罪无法准确界分及认定的难题。究其原因,一方面是对污染环境罪的理解仍停留在重大环境污染事故罪的过去式思维之中,并将污染环境罪与“重大环境污染事故罪”内涵予以等同;另一方面最高人民法院通报的“盐城案”以“投放危险物质罪”予以定罪量刑,以判例形式将“重大环境污染事故罪”与投放危险物质罪的竞合关系定格为想象竞合,并将想象竞合的假象延伸至污染环境罪与投放危险物质罪之中。然而,经过修改后的污染环境罪内涵发生了显著变化,
