ファクトデータベースの著作権に関する以下の問題を,具体的事例に基づき論じた:(1)数値,用語,テキスト,図表,画像等の情報要素が著作物性を持ち得るか,(2)一次著作物からファクトデータベースに取り入れられた情報に,一次著作権者と二次著作権者の権利はどう及ぶか,(3)ファクトデータベースにおける情報の選択または体系的構成が著作物性を持つための要件は何か,(4)他のデータベースの構成を借用したデータベースに著作物性はあるか。著作権法で保護される対象はアイディアでなく表現であるという原則が,データベースのような実務的著作物の保護を考えるとき矛盾をもたらすことを指摘した。
