The Supreme Court of Mississippi ruled that a water utility could not charge an impact fee that was arbitrary and discriminatory. The fee was considered arbitrary because it was not based on calculations to provide for the system's functioning and growth, and it was considered discriminatory because only one new development was charged the fee.
