Abstract This lecture warns that good faith is absolutely necessary in the conduct of public affairs. This is especially so in Native States such as Baroda where frequent breaches of faith have led subjects to discount promises. Good faith is maintained more easily when promises are not made recklessly.

A decision maker (DM) takes a binary decision and cares about their reputation for being responsive to evidence—a non-partisan type—as opposed to having a fixed agenda—a partisan type. Non-partisans have heterogeneous "leniency," i.e., evidence thresholds above which the high action is preferred, whereas partisans always prefer the low action.

This chapter discusses the role of good faith in contract law, first analysing the decision in Walford v. Miles [1992] 2 AC 128, where it was held that an obligation to negotiate in good faith is not valid. It then examines the reasons that led to the decision and also explores its limits.
