Waste Management Research, 1999 家電リサイクル法はわが国の個別リサイクル法としては容器包装リサイクル法に次ぐものと位置づけられる。いずれもその特徴は, 消費者を経て排出された廃棄物の再利用義務を事業者が負うという特徴を持つ。しかしこれらの法律はまた, 発生抑制, 再使用という廃棄物対策としてはプライオリティーにおいて上位に位置すべき施策をその目的に持たないという共通項をも持っている。このことは, 循環経済社会の構築を標榜しながらもそれには不可欠の上流での対策, つまりは製造者責任, 事業者責任を法的に問わないことを意味する。この聖域を打破しない限り循環経済社会の扉は開かれない。家電リサイクル法は果たしてその扉をたたけるものなのだろうか?
