무형문화재를 더욱 적극적으로 보전하기 위해 그 범위를 대폭 확대하고 유형을 다양화했다. 「무형문화유산 보호 협약」을 수용하여 「문화재보호법」을 개정하고 「무형문화재 보전 및 진흥에 관한 법률」을 분리 제정한 것이다. 그런데 이렇게 무형문화재의 범위를 확대하고 유형을 다양화한 것은 단순히 법적 지위를 확보한 무형문화재의 수를 늘리는 데 그치는 것이 아니라, 보전 관점에서 무형문화재의 특성과 환경이 훨씬 다양해진다는 것을 의미한다. 따라서 다양해지는 무형문화재의 특성을 수용할 수 있도록 보전 방법을 다각화할 때 새 법에 근거한 무형문화재의 범위 확대는 실질적 효과를 얻을 수 있다.
