2021This chapter explores the role of arbitral tribunals and courts in the determination of arbitral jurisdiction. It finds that the legitimacy of arbitration trounces its efficacy under Ethiopian law. Any allegation, even a patently false one, that the arbitration agreement is invalid or non-existent has to be settled by a court.
