Patent law and metaverse

open access: yes
The metaverse offers to users a lot of opportunities to develop inventions such as hardwares, softwares, tools and technologies enabling a completely realistic immersive experience. Inventions can be developed for and in the metaverse. Regarding such new technologies, any patent lawyer may raise the question of patentability: Under which conditions can

Phase Field Failure Modeling: Brittle‐Ductile Dual‐Phase Microstructures under Compressive Loading

open access: yesAdvanced Engineering Materials, EarlyView.
The approach by Amor and the approach by Miehe and Zhang for asymmetric damage behavior in the phase field method for fracture are compared regarding their fitness for microcrack‐based failure modeling. The comparison is performed for the case of a dual‐phase microstructure with a brittle and a ductile constituent.

The new conquistadors: Patent law and expressed sequence tags

open access: yes, 2007
It's akin to the old Spanish, English and Portuguese explorers. They would take their boats until they found some edge of land, then they would go up and plant the flag of their king or queen. They didn't know what they'd discovered; how big it is, where

Juridical Practice Concerning the Interpretation of the Right to Oral Proceedings in the European Patent Convention: Focusing on Whether the Right to Oral Proceedings is Violated and Suggestions on How to Protect the Right

open access: yesJournal of Intellectual Property
The right to a fair trial, a fundamental right, has long been regarded essential to protect other human rights. It has been codified in treaties in international human rights law and international criminal law, making it almost universal right in ...

Time‐Dependent Oxidation and Scale Evolution of a Wrought Co/Ni‐Based Superalloy

open access: yesAdvanced Engineering Materials, EarlyView.
This study shows how a new wrought Co/Ni‐based superalloy resists oxidation at 800 ∘$^\circ$C. The oxide scale changes from rough, fast‐growing spinel to a dense, protective chromia–alumina layer. Atom probe analysis reveals tiny refractory‐rich bubbles at the interface that mark the transition to long‐term, diffusion‐controlled protection ...

Patent Reform: Aligning Reward and Contribution [PDF]

open access: yes
Economists and policy makers have long recognized that innovators must be able to appropriate a reasonable portion of the social benefits of their innovations if innovation is to be suitably rewarded and encouraged.

Karl Popper and the Mechanisms of Hydrogen Embrittlement

open access: yesAdvanced Engineering Materials, EarlyView.
Representation of the beginning of loss of ductility rather than embrittlement. Small concentrations of hydrogen in a diffusible form within iron are well‐established to harm the mechanical integrity of steels. There are theories that attempt to explain the pernicious role of hydrogen.

The Relationship between Copyright and Patent Protection in European Union Law

open access: yes, 2015
The purpose of this book chapter is to investigate to what extent technical function can be protected under European Union (EU) copyright law. Technical function has been explicitly excluded under other regimes of protection in the Union, for example ...

Symbolic Regression and Multi‐Objective Optimization of the Flory–Huggins Interaction Parameter for Hydrogels

open access: yesAdvanced Engineering Materials, EarlyView.
We develop a data‐driven method to derive the mathematical expressions of the Flory–Huggins interaction parameter χ for the swelling behavior of temperature–responsive hydrogels. Starting from initial assumptions of χ, our workflow combines Bayesian optimization, Flory–Rehner theory, and symbolic regression to generate candidate χ expressions.

Staging of Venture Financing, Moral Hazard, and Patent Law

open access: yes
The literature on venture financing mainly focuses on entrepreneurial moral hazard. The investor, however, may behave opportunistically, too. We look at the case where the investor demands a higher share on the venture’s return before financing the next ...
