Penal Policy and Practice in Belgium

Abstract Belgian imprisonment rates increased from sixty‐five to ninety‐five per 100,000 population in the past quarter century, and the use of pretrial detention and long prison sentences increased. Notorious crimes, most prominently the Dutroux case, produced mass demonstrations, and a right‐wing political party repeatedly urged harsher policies.

Human Rights and Penal Policy

Structural and cultural changes in the modernization process, combined with contingent historical events, gave rise to a human rights regime. It is codified in the Universal Declaration of Human Rights, promulgated after World War II and the Holocaust. Yet, only the gravest of human rights violations have been criminalized.
