, 2016 自《民法通则》实施以来，赔礼道歉作为一种民事责任方式已经在我国司法实务中适用了近30年。赔礼道歉民事责任在我国得以形成有一定的历史文化原因，它的主要立法目的是化解纠纷，调和矛盾。然而目前的司法实务中，赔礼道歉并没有实现较好的立法效果，反而陷入了适用混乱、执行困难的适用困境。 本文认为造成赔礼道歉适用困境的原因主要有两个方面：从宪法的角度来看，赔礼道歉与宪法所保障的良心自由相冲突，有违宪的嫌疑，这是赔礼道歉民事责任在理论上存在的障碍；从实务的角度来看，由于赔礼道歉具有很强的主观性，不少侵权人抱着“钱可以赔，
