징벌적 손해배상제도는 가해자를 처벌하고 유사한 가해행위의 재발을 방지함과 아울러 사인에 의한 소송을 통하여 불완전집행을 해소하는 것이므로, 시간과 비용을 들인 피해자의 이익을 온전하게 보상하는 것이 필요하다. 징벌적 손해배상제도는 극악무도한 행위에 대한 예외적 구제수단으로서의 성격을 지니므로 가해자의 행위가 매우 비난가능하여야 한다. 제조물책임의 맥락에서는 제조물의 결함과 제조물의 결함으로 인하여 중대한 해악이 발생할 상당한 개연성을 알면서 필요한 조치를 취하지 않은 경우에 징벌적 손해배상이 인정된다.
