The Principle of “Ultima Ratio” And/Or the Principle of Proportionality

open access: yesOñati Socio-Legal Series, 2012
The ultima ratio principle is a highly topical subject. The author describes the common grounds and different perspectives of “ultima ratio” on the one hand and/or the principle of proportionality in German criminal and public law on the other hand.

Proportionality review in administrative law

open access: yes, 2017
At the most basic level, the principle of proportionality captures the common-sensical proposition that, when the government acts, the means it chooses should be well-adapted to achieve the ends it is pursuing. The proportionality principle is an admonition, as German administrative law scholar Fritz Fleiner famously wrote many decades ago, that “the ...

Photoconductivity‐Driven Quantum Efficiency Gain in Inorganic Ruddlesden‐Popper Layered Cs2PbBr2I2 Perovskite Photodetector for Visible Light Detection

open access: yesAdvanced Functional Materials, EarlyView.
Rational halogen mixing strategy was employed to shift the bandgap of Cs2PbBr2I2 from ultraviolet to visible region, enabling first realization of a visible‐light photodetector with this 2D layered Ruddlesden‐Popper perovskite material. Under illumination, light‐induced internal field forms and drives trap‐mediated persistent photoconductivity ...

Proportionality and precaution

open access: yesGlobal Constitutionalism
During the COVID-19 pandemic, governments worldwide invoked the ‘precautionary principle’ to justify policies designed to protect public health. This principle holds that the state may act proactively to avert harm where there is factual uncertainty ...

Charge Transport in Ternary Charge‐Transfer Solid Solution Single Crystals

open access: yesAdvanced Functional Materials, EarlyView.
This study deconvolutes the roles of indirect (superexchange) and direct electronic coupling on charge transport in single crystals of an organic charge‐transfer molecular semiconductor (OSC). This model system elegantly demonstrates that structural defects introduced by chemical dopants play a significant role in the electronic performance ...

Power-law corrections to black-hole entropy via entanglement

open access: yes, 2007
We consider the entanglement between quantum field degrees of freedom inside and outside the horizon as a plausible source of black-hole entropy. We examine possible deviations of black hole entropy from area proportionality.

Muscle Memory and the Local Concentration of Capital Punishment [PDF]

open access: yes, 2016
The modern death penalty is not just concentrating in a handful of practicing states; it is disappearing in all but a few capitally active localities.

Surface Diffusion in SnTe‐PbTe Monolayer Lateral Heterostructures

open access: yesAdvanced Functional Materials, EarlyView.
The lateral heterostructures between 2D materials often suffer from the interdiffusion at the interfaces. Here, a surface diffusion mechanism is found to be dominating at the interfaces between semiconducting SnTe and PbTe monolayers. Atomically sharp interfaces can be achieved by suppressing this diffusion process. ABSTRACT The construction of complex
